This paper focuses on the issues of the development of the Constitution for Europe, though mainly paying attention to the Loyalty principle changes through different stages of political integration within the Union, therefore the main concentration is on the differences between Treaty of European Community (EC) Article 10 and Constitutioin Treaty Draft Articles Nr. 8, 9 and 14.

To understand the development of the loyalty principle it is important to look at the development and debates on the Constitution of the Europe itself, therefore historical issue of the concept development arraises in the second part of this paper. Third part gives the definition of the loyalty principle itself and presents a short overview of the development and appearance of this concept. Fourth part of the paper presents and explains the loyalty cooperation principle as it is defined in the Draft articles for the Constitution of Europa. In the conclusion there is a note of the problem, that might come due to the double legitimacy, therefore loyaltu from the citiznes of the Europe, as such concept has been introdused by the Mastricht treaty and hardly examineted by the Convention for the Draft Article 7. …
